Litigation

The scales of justiceLitigation is probably the most well-known aspect of the Ramblers' Association's rights of way work. It's not the only way we get paths open and easy to use, but it's an area in which we've made huge advances for the walking public.

Due to the costs involved legal action tends to be an option of last resort, but where we identify opportunities to establish favourable legal interpretations, or overturn adverse precedents, we aim to bring test cases before the courts.

In 2007 the generosity of our members helped us win a landmark case in the House of Lords, changing the law to stop applications to recognise rights of way being unfairly defeated.
